Acceptable Use Policy

This Acceptable Use Policy (“Policy”) is incorporated into and forms part of MagicBlocks’ Terms and Conditions (“Terms”), available at https://magicblocks.ai/terms. Capitalized terms not defined here have the meaning given in the Terms. By using the AI-powered services provided by MagicBlocks, Inc. (“Services”), you warrant that your use will comply with this Policy, the Terms, and all applicable laws and regulations. If you do not agree, you must refrain from using the Services. Your continued use of the Services constitutes acceptance of this Policy. This Policy applies to all:
- uses of the Services;
- forms, materials, consent tools, comments, posts, and all other content available through the Services (“Content”);
- material you contribute to the Services, including any upload, post, review, disclosure, rating, comment, or chat (“Contribution”);
- use, implementation, and management of AI Products within the Services; and
- communications transmitted or facilitated using the Services, including SMS, voice, email, and third-party messaging platforms.
1. Who We Are
We are MagicBlocks, Inc., doing business as MagicBlocks (“Company,” “we,” “us,” or “our”), a corporation organized under the laws of the State of Delaware, with offices at 188 Valley Street, Suite 225, Providence, RI 02909. We operate the website https://magicblocks.ai and any related products and services that refer or link to this Policy (collectively, the “Services”).
2. Use of the Services
When you use the Services, you warrant that you will comply with this Policy and all applicable laws. You may not:
- Systematically retrieve data or Content from the Services to create or compile a collection, compilation, database, or directory without our prior written permission.
- Make unauthorized use of the Services, including collecting usernames or email addresses by electronic or other means for unsolicited email, or creating accounts by automated means or under false pretenses.
- Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent copying of Content or enforce usage limitations.
- Engage in unauthorized framing of or linking to the Services.
- Trick, defraud, or mislead us or other users, including any attempt to learn sensitive account information such as passwords.
- Make improper use of our Services or support services, or submit false reports of abuse or misconduct.
- Use scripts, data mining tools, robots, scrapers, or similar automated tools to access or extract data from the Services, except as expressly permitted.
- Interfere with, disrupt, or create an undue burden on the Services or connected networks.
- Attempt to impersonate another user or person, or use another user’s credentials.
- Use information obtained from the Services to harass, abuse, or harm another person.
- Use the Services to compete with us, or otherwise use the Services for any commercial purpose not expressly authorized by the Terms.
- Decipher, decompile, disassemble, or reverse engineer any software comprising the Services, except as expressly permitted by applicable law.
- Attempt to bypass any access controls or security measures of the Services.
- Harass, intimidate, or threaten any of our employees or agents engaged in providing the Services.
- Delete or alter any copyright or other proprietary rights notices from any Content.
- Copy or adapt the Services’ software, including but not limited to HTML, JavaScript, or other code.
- Upload or transmit viruses, Trojan horses, or other malicious material that interferes with the use, features, functions, operation, or maintenance of the Services.
- Upload or transmit any material that acts as an information collection or tracking mechanism (including clear GIFs, 1×1 pixels, web bugs, or similar devices) without our authorization.
- Configure or instruct AI agents to represent AI-generated output as human-generated without appropriate disclosure to the end user.
- Use the Services in a manner inconsistent with any applicable laws or regulations.
- Sell or otherwise transfer your account or profile without our consent.
3. AI Disclosure Obligations
MagicBlocks provides AI-powered tools to help businesses engage with their customers and leads. When you deploy any AI Product to interact with end users on your behalf, you must:
- Clearly disclose to each end user, prior to or at the outset of any AI-facilitated interaction, that they are communicating with an AI system and not a human being. This obligation applies across all channels, including chat, SMS, voice, email, and social media messaging.
- Comply with all applicable AI disclosure and transparency laws in the jurisdictions where you operate and where your end users are located, including without limitation:
- California SB 243 (effective January 1, 2026): requires disclosure of automated communications by chatbots and AI agents;
- Colorado AI Act (SB 21-169, effective June 1, 2026): transparency requirements for high-risk AI systems affecting Colorado residents;
- EU AI Act Article 50 (effective August 2, 2026): disclosure obligations when consumers interact with AI-generated content or AI systems; and
- Utah AI Policy Act, applicable state and federal AI transparency laws, and any successor or equivalent legislation.
- Not configure or instruct AI agents to affirmatively claim to be human when a user sincerely asks whether they are interacting with a human or an AI.
- Not use the Services to generate communications that impersonate a specific real individual without that individual’s express prior consent.
- Implement any disclosure features or tools made available by MagicBlocks to support end-user transparency. MagicBlocks provides configuration options and disclosure tools to assist your compliance efforts, but does not guarantee that any particular configuration will satisfy the AI disclosure requirements of any specific jurisdiction. Compliance with all applicable AI disclosure laws remains your sole responsibility.
4. AI-Specific Use Restrictions
When using the AI Products provided by MagicBlocks, you warrant that you will not:
- Deploy AI techniques that use subliminal, manipulative, or deceptive methods to distort behavior or impair informed decision-making, particularly in ways that cause material harm to individuals.
- Exploit vulnerabilities related to age, disability, or socioeconomic circumstances through AI in a way that distorts behavior or decision-making, especially where this results in significant harm.
- Use AI Products for biometric categorization that infers sensitive attributes, including race, political opinions, trade union membership, religious or philosophical beliefs, sex life, or sexual orientation, except in limited, lawfully authorized circumstances.
- Implement AI-based social scoring systems that evaluate or classify individuals based on social behavior or personal traits in a manner that causes harm, discrimination, or unfair treatment.
- Use AI Products to assess the risk of an individual committing criminal offenses based solely on profiling, personality traits, or non-behavioral factors, outside of narrowly defined, legally authorized circumstances.
- Compile facial recognition databases through untargeted scraping of facial images from the internet, social media, CCTV, or other sources without a lawful, narrowly defined purpose.
- Use AI Products to infer emotions in workplaces, educational institutions, or other sensitive environments where such analysis could lead to discrimination, unfair treatment, or privacy violations.
- Configure AI agents to make autonomous decisions with legally significant or material effects on individuals — such as approving or denying credit, insurance, or employment — without providing a meaningful human review path for affected individuals.
- Use AI Products in connection with industries or activities for which you are not licensed, registered, or otherwise authorized to operate under applicable law.
- Direct or configure AI agents to make statements about your products or services that are false, misleading, or for which you do not have a reasonable basis to believe are accurate.
- Use AI voice or conversational agents to engage in real-time remote biometric identification in public places for law enforcement or mass surveillance purposes.
5. Communications Compliance
MagicBlocks’ AI Products may be used to send or automate communications via SMS, voice, email, and third-party messaging platforms. You are solely responsible for ensuring all such communications comply with applicable law. You may not use the Services to:
5.1 SMS and Text Messaging
- Send commercial SMS or text messages without obtaining prior express written consent as required by the Telephone Consumer Protection Act (TCPA), applicable carrier guidelines (including CTIA Messaging Principles), and applicable state mini-TCPA laws (including Florida’s Telemarketing Act and Washington’s Commercial Electronic Mail Act).
- Send commercial SMS messages without completing all required 10DLC or A2P campaign registration processes where required by carriers.
- Fail to honor opt-out requests from SMS recipients within the timeframes required by applicable law and carrier rules.
- Send messages in violation of the Australian Spam Act 2003 (which requires consent for commercial electronic messages and mandates functioning unsubscribe mechanisms) or any equivalent law in any jurisdiction where your recipients are located.
5.2 Voice and Telephony
- Use AI-generated voice or prerecorded messages in calls to wireless numbers without the prior express written consent required by the TCPA, applicable FCC rulings (including the February 2024 FCC ruling classifying AI-generated voices as “artificial or prerecorded” voices under the TCPA), and applicable state telemarketing laws.
- Place calls to numbers listed on the National Do Not Call Registry or applicable state do-not-call lists without a lawfully established prior business relationship or express consent.
- Use automated dialing technology without complying with all applicable TCPA, FCC, and state telemarketing registration and bonding requirements.
- Fail to disclose that a voice call uses an AI-generated voice where required by applicable law.
- Place calls in violation of the Australian Do Not Call Register Act 2006 or any equivalent law in any jurisdiction where your recipients are located.
5.3 Email
- Send commercial email without a valid physical postal address, without a clear and functional opt-out mechanism, or with false or misleading header information or subject lines, in violation of the CAN-SPAM Act (penalties up to $51,744 per violation per email).
- Fail to honor email opt-out requests within 10 business days of receipt, as required by the CAN-SPAM Act.
- Send commercial electronic messages to recipients in Australia without consent as required by the Australian Spam Act 2003.
- Send commercial messages to recipients in the EU or UK without a lawful basis under the GDPR and applicable ePrivacy rules.
- Send commercial messages to recipients in Canada without complying with the Canadian Anti-Spam Legislation (CASL).
5.4 Third-Party Platform Rules
- Violate the terms of service, developer policies, or messaging guidelines of any third-party platform through which you use the Services, including WhatsApp Business Policy, Meta Messenger Platform Policy, Instagram Messaging, LinkedIn, or any other social or messaging platform.
- Use the Services to send messages via third-party platforms in ways that violate those platforms’ restrictions on AI-generated or automated communications (including WhatsApp’s January 2026 AI chatbot restrictions).
5.5 Lead Data and Imported Contacts
- Import, upload, or push any contact, lead, or recipient list to the Services without having obtained — and being able to produce upon request — individually verifiable, channel-specific prior express written consent from each person on that list for the specific type of communication (SMS, voice, email, or platform message) you intend to send, issued directly to your legal entity.
- Rely on pooled, shared, or lead-generator-supplied consent as a lawful basis for communications. Under the FCC’s one-to-one consent rule (effective January 2025), prior express written consent for SMS and voice communications must specifically identify your business as the intended sender — generic lead-pool or co-registration consent is insufficient.
- Use purchased, rented, scraped, brokered, or third-party-supplied contact lists to initiate communications without independently verifying that each individual on that list has provided the required channel-specific consent directly to your organization.
- Transmit communications to any imported or pushed contact without first screening that list against the National Do Not Call Registry, applicable state do-not-call lists, the Australian Do Not Call Register, and your own internal opt-out and suppression records. You are responsible for maintaining all registrations and subscriptions required to access those registries.
- Import contacts located in the European Union or United Kingdom without a lawful basis under the GDPR and applicable ePrivacy rules, import contacts in Canada without CASL-compliant consent records, or import contacts in Australia without consent compliant with the Spam Act 2003 and Do Not Call Register Act 2006.
- Fail to maintain complete records of the consent obtained for each imported contact — including the date, method, and specific scope of consent — and produce those records within five (5) business days of a written request in connection with any complaint, regulatory inquiry, or legal proceeding. You bear sole and exclusive responsibility for the legality, accuracy, and compliance of all contact data you import, upload, or otherwise introduce into the Services. MagicBlocks assumes no liability for regulatory penalties, carrier sanctions, litigation, or any other consequences arising from your use of non-compliant, purchased, scraped, or otherwise impermissibly obtained contact data. MagicBlocks provides tools designed to support compliant communications but does not guarantee that your use of those tools will satisfy the requirements of any specific law or platform policy. Compliance remains your sole responsibility. MagicBlocks disclaims all liability for regulatory fines, carrier blocking, deregistration, or enforcement actions arising from your non-compliant use of the Services.
6. Subscriptions and Authorized Access
If you subscribe to our Services, you acknowledge and agree that, except where expressly permitted by the Terms:
- You will not engage in any use, including modification, copying, redistribution, publication, display, performance, or retransmission, of any portion of the Services other than as expressly permitted by this Policy, without our prior written consent.
- You will not attempt to reconstruct or discover any source code or algorithms of the Services.
- You will not share your account credentials with unauthorized third parties.
- You will not intercept any data not intended for you.
- You will not damage, reveal, or alter any user’s data, or any hardware, software, or information relating to another person or entity. Nothing in this section prohibits authorized agency or white-label use of the Services as described in the Agency and White-Label Use section below, or as otherwise expressly authorized under your subscription agreement.
7. Agency and White-Label Use
If you access the Services as an agency, reseller, or white-label partner deploying the Services to or on behalf of your own clients (“Sub-Customers”), you agree that:
- You are responsible for ensuring that each Sub-Customer and their end users comply with this Policy and the Terms to the same extent as if they were direct customers of MagicBlocks.
- You must communicate, and where applicable contractually require, all AI disclosure, communications compliance, and prohibited use obligations in this Policy to your Sub-Customers.
- You remain fully liable to MagicBlocks for any violation of this Policy or the Terms by your Sub-Customers.
- All AI disclosure obligations in this Policy apply to white-label deployments regardless of branding. End users of your Sub-Customers must still receive appropriate disclosure that they are interacting with AI.
- You must not represent to Sub-Customers that MagicBlocks endorses or guarantees the compliance of any particular use of the Services with any law or regulation.
8. Industry-Specific Prohibited Uses
If you operate in a regulated industry, you may not use the Services in any manner that violates applicable industry-specific laws or regulations. Without limitation, you may not:
- Mortgage and Real Estate: use the Services in violation of the Real Estate Settlement Procedures Act (RESPA), the Truth in Lending Act (TILA), the Equal Credit Opportunity Act (ECOA), applicable fair lending laws, or applicable state mortgage licensing requirements; or use AI-driven lead qualification or routing in any manner constituting unlawful lending discrimination.
- Finance and Lending: use the Services in violation of the ECOA, applicable state lending laws, or CFPB guidance on the use of AI in lending decisions.
- Insurance: use the Services in violation of applicable state AI disclosure requirements for insurance marketing, NAIC model bulletins on AI use in insurance, or unfair trade practice statutes applied to AI-assisted agent communications.
- Auto Dealerships: use the Services in violation of the FTC’s CARS Rule or applicable state dealer advertising and disclosure regulations.
- Home Services: use the Services in violation of applicable state contractor licensing requirements or local consumer protection ordinances. MagicBlocks provides tools designed to support industry compliance but does not represent or warrant that its AI Products are compliant with any specific regulatory requirement in any particular industry or jurisdiction. You bear sole responsibility for assessing the compliance of your use of the Services with all laws applicable to your business and industry.
9. Contributions
“Contributions” means:
- any data, information, software, text, code, music, scripts, sound, graphics, photos, videos, tags, messages, interactive features, or other materials that you post, share, upload, submit, or otherwise provide through the Services; or
- any other content, materials, or data you provide to MagicBlocks or use with the Services. We may, but are under no obligation to, review or moderate Contributions made on the Services, and we expressly exclude our liability for any loss or damage resulting from a user’s breach of this Policy. Please report any Contribution you believe breaches this Policy; however, we will determine in our sole discretion whether a breach has occurred. You warrant that:
- you are the creator and owner of, or have all necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Services, and other users of the Services to use your Contributions as contemplated by the Services and this Policy;
- all your Contributions comply with applicable laws and are original and true;
- the creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the intellectual property rights of any third party; and
- you have verifiable consent from each identifiable individual in your Contributions to use their name or likeness as contemplated by this Policy. You agree that you will not post, transmit, or upload any Contribution that:
- violates applicable laws, regulations, court orders, contractual obligations, this Policy, the Terms, or a legal duty, or promotes or facilitates fraud or illegal activities;
- is defamatory, obscene, offensive, hateful, insulting, intimidating, bullying, abusive, or threatening to any person or group;
- is false, inaccurate, or misleading;
- includes child sexual abuse material, or violates any applicable law concerning child pornography or the protection of minors;
- solicits personal information from persons under the age of 18, or exploits persons under the age of 18 in a sexual or violent manner;
- promotes violence, advocates the violent overthrow of any government, or incites, encourages, or threatens physical harm against another;
- is obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or sexually explicit;
- is discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age;
- bullies, intimidates, humiliates, or insults any person;
- promotes, facilitates, or assists any act of terrorism;
- infringes, or assists others in infringing, a third party’s intellectual property, publicity, or privacy rights;
- misrepresents your identity or affiliation with any person, or implies that a Contribution was made by someone other than you; or
- contains unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, or mass mailings. You may not use our Services to offer, promote, sell, or make available any goods or services involving:
- items that promote, encourage, facilitate, or instruct others in illegal activity;
- cigarettes, tobacco products, or e-cigarettes where prohibited;
- controlled substances, narcotics, steroids, or drug paraphernalia;
- specific knives or other weapons regulated under applicable law;
- firearms, ammunition, or certain firearm parts or accessories;
- sexually oriented materials or services in violation of applicable law;
- stolen goods;
- products or services identified by government agencies as highly likely to be fraudulent; or
- any transaction or activity requiring regulatory pre-approval that has not been obtained.
10. Reviews and Ratings
Where your Contribution is a review or rating, you also agree that:
- you have firsthand experience with the software or services being reviewed;
- your Contribution is true to your experience;
- you are not affiliated with competitors if posting negative reviews, and are not the owner, seller, or manufacturer of a product or service if posting positive reviews;
- you will not make or offer any conclusions as to the legality of conduct;
- you will not post false or misleading statements; and
- you will not organize or encourage campaigns to post reviews, whether positive or negative.
11. Artificial Intelligence — Responsible Use Commitment
We recognize the significant impact AI can have on individuals and society. We are committed to ensuring that our AI Products are designed and operated in accordance with principles of fairness, transparency, and accountability. This Policy applies to all AI-powered features, services, and systems in our Services and governs their use by customers, third-party vendors, and partners who interact with our AI Products.
11.1 Enforcement
Misuse of our AI Products or failure to adhere to the standards in this Policy will result in appropriate action. The specific consequences depend on the nature, severity, and context of the violation. Violations may include, without limitation:
- Using AI Products in ways that violate user privacy, manipulate data, disregard ethical guidelines, or violate AI service provider terms of service.
- Deploying AI in a manner that introduces or causes bias, leading to unfair treatment of users or groups.
- Improper handling, storage, or use of data through AI Products, leading to breaches of user trust or legal compliance.
- Using AI in a way that compromises the privacy or security of our systems, data, or users.
- Violating the AI disclosure obligations or communications compliance requirements of this Policy. We may take one or more of the following actions in response to a violation:
- Formal Warning: requiring immediate cessation of violating practices.
- Temporary Suspension: suspending access to AI Products or certain platform features while an issue is investigated.
- Termination of Access: permanently terminating access to AI Products and Services for serious violations, particularly those resulting in harm to users, data breaches, or legal violations.
- Legal Action or Regulatory Reporting: reporting incidents to law enforcement or regulatory authorities where required or where a violation involves significant harm, data breaches, or legal violations. We are committed to correcting any harm caused by misuse of AI and implementing additional safeguards to prevent future violations. We regularly review and update this Policy to reflect technological developments and evolving legal requirements.
12. Reporting a Breach of This Policy
If you believe any Service, Content, or Contribution:
- breaches this Policy, please email us at [email protected], including details of the specific Service, Content, or Contribution at issue and the nature of your concern;
- infringes any third-party intellectual property rights, please email us at [email protected]; or
- raises a concern about an AI interaction, please include specific details about the interaction, the nature of the concern, and any relevant screenshots or documentation. We will reasonably determine whether a Service, Content, or Contribution breaches this Policy. We may, but are under no obligation to, review or moderate Contributions, and we expressly exclude our liability for any loss or damage resulting from a user’s breach of this Policy.
13. Consequences of Breaching This Policy
Consequences for violating this Policy will vary depending on the severity of the breach and your history on the Services. We may warn you and/or remove the infringing Contribution. For serious or repeated violations, we have the right to suspend or terminate your access to and use of the Services and, if applicable, disable your account. We may also notify law enforcement or issue legal proceedings where we believe there is a genuine risk to an individual or a threat to public safety. We exclude our liability for all action we may take in response to your breach of this Policy.
14. Disclaimer
MagicBlocks is under no obligation to monitor user activities and disclaim any responsibility for any user’s misuse of the Services. MagicBlocks has no responsibility for any Content or Contribution created, maintained, stored, transmitted, or accessible through the Services, and is not obligated to monitor or exercise editorial control over such material. If MagicBlocks becomes aware that any such Content or Contribution violates this Policy, MagicBlocks may, in addition to removing such material and blocking your account, report the breach to the appropriate regulatory authority or law enforcement. Unless otherwise stated in this Policy, MagicBlocks disclaims any obligation to any person who has not entered into an agreement with MagicBlocks for the use of the Services.
